Texas State & Federal Law #3185 & Immigration Enforcement

By Julia Anne Lewis, Education Dynamics | Thu, 28 Sep 2017

There is good news for Texas peace officers, jailers, prosecutors, and judges who are anxiously awaiting the online publication of the 2017 Texas State & Federal Law Update #3185. Online training provider, OSS Academy has just launched their Texas Commission on Law Enforcement (TCOLE) course.

During the 2017 legislative session, the legislature passed SB 4 a state immigration-enforcement law that outlaws "sanctuary" jurisdictions in Texas. The requirements for law enforcement agencies and their officers are also spelled out in this new course. This issue, among many others, is presented in this required course.

After the legislature adjourned, on September 25, 2017, the 5th Circuit Court Appeals unanimously ruled that major parts of Texas' sanctuary cities law remain in effect, which overruled a lower court's decision to block it temporarily. This ruling allows the State of Texas to enforce two key sections of the law, while setting a hearing on the punitive effects. This decision says the state can continue to require law enforcement “to honor federal immigration requests to detain people in local jails for possible deportation.”
